Here we are with another rant about (removed) marketers…
If you don’t know the “Wacky” story by now, then this will be some fun
reading.
More than two years ago the “Wacky” concept was born, with the first site
being WackyWednesdaySale.com
Kathe Lucas and Denise Hall came together in January 2008 to do a re-launch
of the main site and the “wacky gals” soon added WackyWeekendSale.com
and, as many of you know, now have WackyWeekly.com active, the support
desk at WackySupport.com and have legal ownership claim to MANY other
variations such as TheWackyGang.com, WackyGals.com, and including WackyTeam.com,
TheWackyTeam.com, and our NEWEST PROJECT, WackyCentral.com (coming soon).
We’ve worked very hard from day one to build our “Wacky” brand as one that will
represent integrity, honesty, good product packages, fair prices and prompt
customer and affiliate support.
Six months or so into our “Wacky” journey in 2008, some (removed) came along and
began selling similar products on a similar domain called wacky wednesday
“DEALS” which didn’t delight us, but we certainly can’t tell anyone what to
call their website or what domain to use.
But THEN we began to notice he was copying us in other smaller ways, too, in
order to build “his” brand, we felt, from our success.
This kind of thing can be very confusing to folks out there, and before long
we had people associating us with this guy and his “DEALS” site.
Kathe approached the owner of the site and asked that he possibly not use the
same wording or sign his sales pages in the same way and was met with a harsh
and bitter response where he basically told us WE infringed upon HIS brand…lol
We laughed it off and figured “what will be, will be” and although he still
has sales, there’s no consistency and we were confident in our own branding
attempts, that they were working and soon, folks were familiar with “The
Wacky Gals” and their weekly sales
BUT…
Here we are facing the same low handed tactics where NOW the guy must be
ashamed of HIS name, because he has resorted to using the verbiage of another
domain we own and lingo we use for where we’ve grown into “The Wacky Team”
(we even own the ‘WackyTeam’ gmail account from which we send our emails.
AND WHAT’S WORSE IS…
He has JUST released an “illegal” product for sale in which the PLR license
specifically states the product CANNOT be sold until March 2, 2010. (Sorry,
we won’t give him the benefit of a backlink here, but we will say the product
is about 21 ways to make money.) We have promoted the original PLR, and many
of you have purchased it here: ezclik.com/is/fastcashPLR
Now, there’s no mistake about it, he has BLATANTLY disregarded the license
terms, and while we have notified our friend Aurelius, we surely don’t want
anyone confusing our good name and brand with HIS site or lack of integrity
in this instance.
Now, we know we have some very loyal followers of our Wacky sites (thank you!)
and we just want to ask you to please be sure you know exactly WHO you are
dealing with when you see the word “WACKY” on a sales page.
Unfortunately, some marketers will do anything to capitalize on the hard work
of others, copy their methods or business plan, yet we don’t want anyone
getting taken for a ride by such people if we can help it.
So if you purchase that product before March 2, 2010 you will have obtained it
under false conditions, and more than likely his license will come into question
and could affect your product and sales as well. Should you happen to purchase
the resell license and sell it before that date, YOU too, will be in hot water
with the product creator and your own reputation could be questioned.
‘Nuff said?

I wonder if there is a way to protect your “brand” from stuff like this? One would think, given the recent ruling by the FTC? or was it the FCC, on advertising, if it wouldn’t be in your interests to create a “fabulously fake” product and see if this fraud will take the bait, it would make for a real interesting blog post, I’m sure.
As with any other offers, I believe that the best way for any buyers is to keep in mind the old adage, “Buyer Beware!” unfortunately, there are more “suckers” born every minute than “cautious buyers” so this will probably end up a losing battle for you all. And, I for one, am sorry about it, as you have always been a great marketer and one of the very few more interested in helping the newbies than any others I have come across.

It was a similar incident with my own products that had me rethink my own process. (I think you’ll remember, as you were instrumental in helping me to figure out a solution!)
I DO think something should be done… and would enthusiastically back any type of solution that came along.
That said, you Wacky Gals have nothing to worry about when it comes to the integrity of your brand – at least by those of us who know what kind of ethics and value that you strive to put into every single sale.

Sorry to hear about your troubles, but it comes as no surprise – remember when I started the first $7 site? LOL
Short of going to the expense of Trademarking the name or term, or registering a corporation with the name there’s no way to ‘protect’ it per se, but the great job you do of branding yourselves keeps you ahead of any other ‘wacky’ group or individual.
Just be sure you have your main Wacky variations at all of the social marketing and social bookmarking sites, use the terms and your pics or avatar everywhere (like at the end of your blog posts) and trust that your honest & caring approach will continue to keep you above the charletons.

Have you considered getting the Wacky brand trademarked? If you trademark Wacky you can stop that particular marketer and any others who might want to tarnish your reputations. If a certain company can trademark the prefix Mc than you should be able to trademark Wacky. If I don’t see your names at the bottom of a wacky site I don’t trust or purchase from them.

It can certainly be depressing to see someone use and abuse your good name. Fortunately, you were able to hear about the tactics being used and let your readership know what is happening. Too often, the damage is done before hand and you are left trying to salvage instead of prevent. It is ironic that mentioning the website would actually help this individual out with a backlink. Let’s hope any future efforts are consistently caught as well. If it is done enough times, he may be encouraged by those effected to move along.

Hi, this is Tony Grant here and I have experienced your first class service many times. I have kept you on my subscribed list for so much longer than many other marketers as your offers are mostly refreshing and great deals.
I would however like to say in this instance that the person who has done this will get what is due in time. What goes round, comes round etc etc. Therefore, I might suggest that you just rise above it all, turn a blind eye and not sink to his levels by entering into such an exchange of emotions.
I can’t really say if your method is right, wrong, justified or other but it just leaves a bit of a taste in the mouth. Rather like a court battle, no one ultimately wins and everyone ends up feeling dirty.
So, focus on what you do best and keep bringing that to us then let the slime slide out of the door and into the sewer where they belong.
Rant #2 over but of course, rant is the last 4 letter of my surname so maybe I have a birthright hehe.

I’m a fan of the wacky girls, team, gang, and all the other marketing names of Kathe and Denise. However, after reading this rant, I decided to do a little investigating myself just out of curiosity.
I went to the site wackywednesdaydeals dot com, and yes, you’re partially correct as far as the guy with the same last name as me selling the same product which you are promoting the PLR for.
Not that I am in defense of what he has done in the past or is doing now, but there is no live link on his site to order the product. It clearly states that the product can not be ordered until March 2 for the price of $7.00 with master resell rights.
Now I’m confused about what is illegal about this. Even though he has put up a sales page for the product, he’s still not selling it until the date according to the PLR License because he’s not actually selling it until the license date.

You might wish to visit Icann’s site they look after domains. You have several domains and your USP. If your domains were registered before his they might do something for you.
It doesn’t take long and he might have to stop. At this point it is free to try this for yourselves.
You can stop if it is going to cost, But Icann runs the domain name setup.

It always amazes me when somebody takes advantage of someone else’s hard work and takes the credit for it(and the money). It is sad but true. It happens all the time. It just goes to show you that whatever you do you have to cover all your bases in order to CYA!(Cover your A**).
I have learned the hard way to evaluate whatever I do on the Internet in terms of the possibility of being ripped off. You have to make a pro-active, peremptory strike to foil those who would steal from you.

Sadly, this happens all too often. And you can put “copyright …….” till the cows come home and there are people who will defy your proprietary rights.
Because I am an “old fart” and started my first business at 12, over the years, I have had to deal with scum like this. The real problem, and one that cost me millions of dollars a few years ago, including forcing me into bankruptcy, is that the government, as invasive as it has become, did nothing to help. In fact, they indirectly facilitated this scam! Here is how it went down:
Years ago, I started a business in a very small, niche industry. I trademarked everything I could and got a great attorney. I grew the business in less than one year to a six-figure net income. Four years later, a competitor came out of the woodwork and started competing me on the net. I was engaged in a lot of other things so I allowed the business to grow on it’s own. He, by contrast, worked diligently to grow the business and was lucky enough to inherit a few million dollars. I ran into him in Minnesota at a seminar and he looked me in the eye and said,”I am going to put you out of business!” I had never even me the guy! But I went away thinking I had encountered a nut job and dismissed it. A couple of months later, I was served with a summons and realized he was suing me for unfair business practices. I still felt this would go away, but I had to hire an attorney specializing in this kind of litigation at a cost of $500. plus per hour. We were deposed numerous times over a period of four years at a cost that ran in the millions. In the end, my attorney told me that he wasn’t going away and the best thing to do was to either continue to drain my resources or settle out of court. I asked myself what planet I was on. In the end, I gave up. The government offered no assistance. They actually support the legal system. After all it is about attorneys that get paid well for their services so the continuing answer I got from everyone around me was, you will have to fight it out in court.

It’s me, the “Bozo”, the “unscrupulous marketer”, the “copy cat”.
I will come right out and tell you, I AM GUILTY. I am guilty of NOT READING the PLR license (stupid on my part for sure). I have bought a number of Aurelius Tjin’s products in the past and I know the terms (at least I thought I did).
I did however read the Master Resale Rights license since it is the one my customers will be receiving. It does not have a date mentioned. Of course that’s because the customer shouldn’t receive the product until at least March 2, 2010.
I have deactivated the order link on the product in question. Posted a nice statement explaining what happened. apologized to Arelius for violating his license, And I provided a free video course that can be downloaded directly from the sales page. You can get the video and see what I posted at (wacky gal edited out the link) (oops, there’s my backlink).
There you have it, I made a mistake. I’m guilty as charged of selling an illegal product due to my own stupidity, ignorance, or whatever else you want to call it. And I’ll tell you right now, I’ll probably end up making more mistakes today, even more tomorrow, and a whole lot more down the road. I’m only HUMAN!
Mistakes are no big deal. I strive extremely hard not to make them. But they happen. What’s important is the way they are handled. I have always taken full responsibility for my actions. I don’t make excuses for what I do or have done. I tell the honest truth. I made a mistake because I didn’t read the PLR license.
That’s really all I came here to say.
But since I’m here. Let’s get this out in the open. I could care less what Kathe Lucas thinks, or what she does, or what she likes, or what she dislikes. As for Denise Hall, I don’t know much about her. She seems to be a really sincere person.
But I digress. I registered my website WWD.com (just to avoid the backlink again) in August 2007. Why did I pick that name? Because it was the first one I typed in at GoDaddy. And it was available. So the name then sat unused for about six months or so.
Then like a “bozo”, I launched it in March 2008. I had no knowledge of Kathe’s site until January 2008. At that time, I seriously considered not launching my site at all. But I did. Mostly as a means of testing new programming that I had worked for nearly a year.
I wasn’t interest in copying anyone, confusing customers, stealing someone’s brand name, or whatever else I’m accused of doing. I just made a site so I could test a script and make some money on the side.
And yes, Kathe did approach me once. She accused me of undercutting her sale. She offered a product for $27. I had a special for $7. Happens all the time on the Internet. Get over it!
I told her at the time what had happened. I was unaware of her sale. But I also told her that I did not like be accused of doing something wrong that I had not done. I told Kathe that I wasn’t interested in playing games. I didn’t copy anyone, I didn’t try to undercut her, and I wasn’t trying to confuse anyone.
So there you have it.
There are two sides to every story. Had anyone approached me about my illegal sale, I would have thanked them, taken the appropriate action, and went on with life.
But now we have this post to contend with. Well, I’ll make it easy. You’ve seen Kathe’s side. You’ve seen my side. That’s it. Life goes on now.
And imagine, I did all that explaining without any name calling.

I think your attitude continues to shine through here, but hey, that’s just me. There are a couple of “untruths” here as well, but what the heck, we’ll let those slide too. One only needs to look up “who is” to see the dates and such, but since we also worked with a gentleman you were working with at the time you released your site, it all just has always seems a little fishy to us here.
Apology accepted (if this is what that is) and “we forgive” and can hopefully put this behind us now…I have a really funny feeling though that you will continue using terminology and signatures that will mislead folks, or that could CONFUSE them into thinking “WE” are related in some way to your site. That in itself is telling as I have kindly asked you to be aware that it IS confusing to some. This, of course, was where I was personally met with the harsh attitude (I considered it was an age thing, maybe a sense of entitlement you felt you had or something, who knew).
Needless to say, if you look at our own “wacky” history…I don’t think we have EVER sold a “wacky” for $27…lol (so, your mention that my initial contact with you was all price related really doesn’t hold water at this point). I merely refused to acknowledge your original response back to me due to the pompous attitude (well, and because your accusation that we took the “idea” from you was a little preposterous).
If you merely need (or needed) a domain for testing…we have over a thousand at any given point in time and would have gladly accomodated you.
Again, all we are simply asking is that you try not to “intentionally” mislead folks into thinking we are one and the same. The rest is up to you. We publish almost like clockwork weekly and have for over two years now after the original launch in October 2007!

Yup… you are right… ethics is fast becoming a lost value.
Intellectual property theft is rampant… but I think Jinger Jarrett had it right when she suggested you just keep giving great value and customer service… and your ethically challenged competitor will fade away.
I am daily amazed at how many of my articles, which have been published in hundreds of respectable publications, end up being used in thousands of blogs and put through article spinners so many times that they are literally unreadable. They never seem to get around to giving proper attribution or links… they just steal your work. I tried fighting this… but the job is overwhelming and it is easier to just ignore the jerks and keep moving ahead.
This is not to say that it does not upset me.. it does… a lot! But, we only have so much time and creative energy available to us… we should use it to create positive things… not get mired down in the cesspool that these jerks seem to want to play in.
So, just keep on keeping on… grumble and vent… but do not let it hold you back from doing those things which have earned you such a well deserved reputation for giving great value and great customer service.
There is only one “Wacky Team” as far as I am concerned…

Unfortunately, this isn’t something new. It isn’t even new to the internet era. I have been a freelance illustrator/designer since 1984 and I can’t even count the number of times my work has been hijacked by lowlife butt-heads. The biggest problem that you face is you are the person who has to spend the up-front $$ to combat the illegal activity. Sending a “Cease and Desist” order still costs money – even now in the instant “legal zoom” age of business law.
Bottom line … there will ALWAYS be people out there who have no care for ethics, morals or laws. You have to take the bad with the good and continue to do good work. You will benefit from your good work.

I have had people who told me they didn’t like material I used, only to go out and include it in their own routines (on TV no less) making it unuseable in the future for me, because I then looked like the copycat after they were exposed to millions on TV with a joke I developed.

Yep, you guys do good business and yes, it is said that the sincerest form of flattery is imitation. You know, “don’t reinvent the wheel” and all that kind of stuff.
As you can see competition has kept you on your toes. Do you feel that the other wacky is STEALING market share or just flattering you because the other wacky sees what a good business model you have.
I see it this way … the niche that you have decided to market in, Internet Marketing, is seriously competitive. If you continue doing business as you normally do, which is excellent by the way, you should have no problem.
And, yes, a little controversy is always good for business. Look how many people have responded here that truly love what you do.
Again, as I see it, you really have no problem other than the other wacky not reading the rules.

I must admit, I’ve never had any contact with you guys. Sounds like its my bad, that you are scrupulous, professional, and offer a good service. In fact, judging by the comments I’ve read, I would be very interested to be added to your contact list.
It’s interesting that all these internet marketers (and maybe I make a generalization here) commenting here have enough time on their hands to be able to comment! I learned a wee while ago that I had to focus my efforts to be successful, and not get sidetracked by the battles of others.
In my defence, it’s 1.30 am, and I am browsing because I consider this my free time (lol). Just call me an interested bystander………………..
Yes, all the cliches have come out of the woodwork (e.g., references to Karma, what goes around, comes around, etc) and they’re all true.
But at least you gals have some confirmation of your standing with your followers and (presumably) fellow marketers. Even if you’ve been wronged, vindication for your personal beliefs and, indeed, your self-esteem, must be at an all time high!
I think Tony Grant epitomises the whole situation in his comment: “rise above it”. At the end of the day it is the relationship you build with your followers that is important. Don’t cheapen it by resorting to personal attacks.
At the end of the day, it only serves to spread the poison further, where in reality, you should be focusing on what you do best: providing a top notch service to the followers you have, and casting your net further to increase your followers. (Hey….you’ve got me? lol) Some of us on the outside (that have never had any contact with you) may even (tongue in cheek) think this was all some kind of publicity stunt!)
If you are looking for vindication for your integrity, just read the comments here; you’ve certainly found it! How about another saying (via a very old song) “Accentuate the Positive”?
I believe that the person in question actually logged a blog comment here, but you have chosen not to publish it. Of course, that is your prerogative, but don’t you think that your standing amongst your own followers would be better served by printing the comment from your adversary?
Another cliche comes to mind: “It takes two to tango”.
Do you honestly think you do yourselves any favors with your followers by not printing a reply?
My personal belief is that, you guys obviously have so much support, and so much value placed in your integrity, the least you could do is to print the explanation that has been forwarded to you. (Like, fair playing fields, full disclosure, etc)
I’m confident that even printing the explanation will in no way sully your reputation. On the contrary, you can show your followers both sides to the story, and they can make up their own minds.

No problem. What I/we want to stress yet again is that we don’t have a case against this guy personally, only that he would use his own name and not confuse folks by having “wacky team” as his signature? I’m sure it’s hard to read through all the posts and comments, but I’ve said this.
There was never any intention to “smear” or do whatever else it appeared we were doing. We were merely trying to let others know “it wasn’t US that put out a product that was not supposed to be released until next week” … that’s where this all started. Had the guy used his own name, (and, ah, been kinder in our past dealings) it probably wouldn’t have stirred us here so much, although Aurelius is a good friend to us and has been for some time, so we hated to see HIS product degraded and being sold against license terms.
LOTS of marketers are giving away and releasing products against licenses out there. On the other hand, lots of marketers don’t know how to write clear licenses either. But since we were selling this particular product already, we simply did not want others to think “that” Wacky was “our” Wacky.
Hopefully that clears things here, and yes, we have been totally moved by the responses and have a renewed commitment to our original business plan.
And to “Accentuate the Postive” we feel we’ve also given some folks an opportunity to share their own grievances that ALL of us marketers could learn by.

In most parts of the free world a person has the right to face his accusers and tell his side of the story.
I know the person in question very well and one thing is for certain he is an honest and stand up guy who would never intentionally do anything underhanded.
It is my understanding that he actually registered his domain before you did and had no knowledge of your existence prior to launching his site. If true, how can you justify making such a damaging post?
A couple of years ago, another marketer smeared my name and I made the wrong decision to not go public with my side of the story. In hindsight, it was a mistake because the only thing people knew is what that person said.
In the spirit of fairness, how about allowing the accused to post his side of the story on this board and let the people decide how they should view him and his practices?

BUT…please do go to Who Is…we had the domain prior to Shawn AND released prior to him (he even says that he knew we were there). We’re not trying to control or doing anything underhanded, i will say this ONE LAST TIME.
THE POST was a result of the use of “Wacky Team” as the ONLY signature with the promotion of something that was not being sold according to license…that’s it!
We were merely looking out for our own reputation and relationship with Aurelius because so often folks refer to US (and i’m sure on that end too) as simply “wacky.”

I liked you both from the “day” you arrived in my in-box(es), and you were one of the few I was speaking of in my post about “incessant emails do not necessarily generate more sales,” because you don’t do it. When I see an email from you, I know it’s worth a peek, or you’re sending me updated information, or, goodness, even apologizing as Liz Tomey did for writing me “too much.”
Ethics are extremely important to me, and you’ve demonstrated them to me. You may think you’re just running a business, but do remember, you never know how you are affecting others unless they tell you. So, I’ll tell you—when the information overload has gotten too much; when I’ve made impulsive “dumb” decisions; when I’ve felt like giving up, seeing one of your emails helped me to keep going. I haven’t, and I won’t give up!
I remember when I first read “Greed is no way to run a business or a life,” I knew I’d like you. I’ve never even heard of “whomever,” and even in the “free world,” we have ethics—goodness, even prisons have them

Whilst it is true that “imitation is the sincerest form of flattery,” when it affects, or has the ability to affect, your brand/business/credibility, then this form of ‘imitation’ is reprehensible.
There are laws in place to protect your “intellectual property” and they are very enforceable on the Internet. YOU came up with the concept of your websites/promotions/ideas, and they are protected, even without lodging ©Copyrights. Anyone trying to “cash-in” on your dream, your product, your brand, etc., can be prosecuted. Put a notification on ALL of your websites, basically stating that you hold Intellectual Property Rights to all ideas, content, brand recognition, etc., and also state that infringement of these rights will result in criminal proceedings being instigated.
When you detect anyone copying what you are doing, hit them with a stern email pointing out the error of their ways. Naturally, if you want your subscribers to follow in your footsteps and use your ‘success blueprint’ as an example, merely add “unless granted a license to do so” to your Intellectual Property Rights notice. It is similar to giving them an “Authorized Reseller” Certificate.

Doug Champigny’s advice is probably the best here, even if one is generous about the “other sides’s” position and claims.
It has been interesting reading the posts from your many supporters, and even following the links to some of their sites I hadn’t yet seen.
You two were the first “Wacky” ones I encountered, and I have not associated that brand with anyone else. You are serving us all well, so just continue and any attempted imitators will be evident enough to most potential customers/subscribers. As your brand strengthens, the fakers will find it harder and harder to seem credible, particularly if you use available software tools to guard your online intellectual property.
Also, if you keep up with all the latest necessary online legal forms, your imitators will be forced to either go to similar expense or risk copying that too — in which case the attorney who set up your (presumably copyrighted) online legal forms can (and likely would) sue the pirate directly.

Please don’t let this bother you to much as you seem to have enough support, for obvious reasons.
